TERMS & CONDITIONS

Welcome to PROB.AETION (“PROB.AETION,” “we,” “us,” or “our”). By accessing or using probaetion.com (the “Site”), purchasing products, submitting forms, requesting custom work, or otherwise engaging with our services, you agree to be bound by these Terms & Conditions.

If you do not agree to these Terms, please do not use this Site.

  1. ELIGIBILITY

By using this Site, you represent that you are at least the age of majority in your state, province, or country of residence, or that you have permission from a parent or legal guardian to use this Site.

  1. ORDERS & PAYMENTS

All payments processed through this Site are handled through trusted third-party payment providers, including but not limited to Stripe, PayPal, and Square.

PROB.AETION reserves the right to refuse, cancel, limit, or terminate any order, account, transaction, or service at our sole discretion, including but not limited to situations involving suspected fraud, abuse, unauthorized activity, pricing errors, inventory issues, or violations of these Terms.

  1. PRODUCT AVAILABILITY

All products are subject to availability.

Certain products may be offered in limited quantities, limited editions, or one-of-one releases. We do not guarantee future availability of any item once sold out.

Product colors, images, and appearance may vary slightly depending on screen settings, lighting, production methods, and manufacturing variations.

  1. CUSTOM PRODUCTS & COMMISSIONS

Custom products, commissions, artwork, apparel modifications, design services, and special requests are reviewed individually by the Artist.

Submission of a custom request does not guarantee acceptance.

If approved, the customer will receive a project estimate and invoice. Work will not begin until full payment has been received unless otherwise agreed upon in writing.

Due to the personalized nature of custom work, all approved custom orders are final and non-refundable once production has begun.

Customers acknowledge they are familiar with the Artist’s style and artistic approach prior to submitting a request.

  1. SHIPPING

PROB.AETION offers domestic and international shipping where available.

Shipping times are estimates only and are not guaranteed.

Customers are responsible for providing accurate shipping information. PROB.AETION is not responsible for delays caused by shipping carriers, customs processing, weather events, incorrect addresses, or circumstances beyond our control.

Shipping availability may change without notice due to carrier restrictions, customs regulations, or regional limitations.

  1. RETURNS & EXCHANGES

All sales are final unless otherwise required by law.

Due to the limited, collectible, custom, or made-to-order nature of many PROB.AETION products, returns, refunds, and exchanges are generally not accepted.

If a non-custom item arrives damaged or defective, customers must contact us within 48 hours of delivery and provide clear photographs of the issue.

Any approved replacement, repair, or resolution will be determined at our sole discretion.

  1. LOST, STOLEN, OR DAMAGED SHIPMENTS

Once an order has been transferred to the shipping carrier, ownership and risk of loss pass to the customer.

PROB.AETION is not responsible for lost, stolen, delayed, misdelivered, or damaged packages caused by third-party shipping carriers.

  1. INTELLECTUAL PROPERTY

All content displayed on this Site, including but not limited to artwork, illustrations, graphics, logos, branding, photographs, product designs, text, videos, concepts, and creative materials, is the exclusive property of PROB.AETION and/or b.ae and is protected by United States and international intellectual property laws.

No content may be copied, reproduced, distributed, modified, sold, republished, infringed upon or used without prior written permission.

Unauthorized use may result in legal action.

  1. FEEDBACK & SUBMISSIONS

Any suggestions, ideas, feedback, comments, proposals, submissions, or materials voluntarily provided to PROB.AETION may be used, modified, published, or incorporated into future projects without compensation or obligation to the sender.

You represent that any materials you submit do not infringe upon the rights of any third party.

  1. PROHIBITED USES

You agree not to:

• Violate any applicable laws or regulations.

• Submit false or misleading information.

• Attempt to interfere with the operation or security of the Site.

• Upload viruses, malware, malicious code, or harmful content.

• Use the Site for fraudulent activity.

• Harass, threaten, abuse, discriminate against, or harm others through use of the Site.

• Attempt to gain unauthorized access to systems, accounts, data, or services.

  1. DISCLAIMER

This Site and all products and services are provided “as is” and “as available” without warranties of any kind, either express or implied.

PROB.AETION does not guarantee uninterrupted access to the Site or that information presented on the Site will always be complete, accurate, current, or error-free.

To the fullest extent permitted by law, PROB.AETION, its owner, affiliates, contractors, suppliers, and service providers shall not be liable for any indirect, incidental, consequential, special, exemplary, or punitive damages arising from the use of this Site, products, services, or related transactions.

  1. INDEMNIFICATION

You agree to indemnify, defend, and hold harmless PROB.AETION, b.ae, affiliates, suppliers, contractors, service providers, and representatives from any claims, liabilities, damages, losses, expenses, or legal fees arising from your use of the Site, violation of these Terms, or infringement of any rights of another person or entity.

  1. CHARGEBACK FRAUD

Fraudulent chargebacks, payment disputes made in bad faith, or attempts to obtain products or services without payment may be reported to payment processors, financial institutions, collection agencies, and law enforcement authorities where appropriate.

  1. MODIFICATIONS TO TERMS

PROB.AETION reserves the right to modify, update, replace, or remove portions of these Terms at any time without prior notice.

Continued use of the Site following any changes constitutes acceptance of those changes.

Your use of this Site is also governed by our Privacy Policy.

  1. GOVERNING LAW

These Terms & Conditions shall be governed by and interpreted under the laws of the State of California and the United States of America, without regard to conflict of law principles.
